Promotion terms & conditions.

Promoter

The promoter is Kooka Digital, ABN 91 974 758 905 (“Kooka Digital”, “we”, “us” or “the Promoter”).

Promotion period

The promotion opens at 12:00 am AEST on 10 August 2026 and closes at 11:59 pm AEDT on 10 November 2026 (“Promotion Period”).

All dates and times stated in these terms refer to the local time in Sydney, New South Wales. Entries cannot be issued before or after the Promotion Period.

Eligibility

Entry is open to a person or business that:

• is based in New South Wales, Australia;
• is at least 18 years old, where the entrant is an individual;
• has the legal authority to commission the project on behalf of the named business;
• commissions an eligible Kooka Digital project during the Promotion Period;
• accepts the applicable project proposal or agreement and pays the required initial payment during the Promotion Period; and
• complies with these terms and the payment conditions of the project agreement.

Employees, contractors directly involved in running the promotion, immediate family members of those persons and anyone involved in determining the winner are not eligible to participate.

Kooka Digital may request reasonable proof of identity, age, business ownership, authority or project payment before confirming eligibility.

How to enter

An interested business may begin by submitting the project enquiry form on the Kooka Digital website. Submitting an enquiry does not itself constitute an entry into the promotion.

To receive one valid entry, the entrant must:

1. discuss the proposed project with Kooka Digital;
2. receive and accept a written project proposal during the Promotion Period;
3. pay the deposit or initial amount specified in that proposal during the Promotion Period; and
4. receive an official unique entry code from Kooka Digital.

The official entry code will ordinarily follow the format K10K-2026-00001. Only a code generated and recorded by Kooka Digital’s promotion system constitutes a valid entry.

Eligible projects

An eligible project is a new website design, website development, eCommerce development, website redesign, branding or related digital project that Kooka Digital expressly confirms as eligible in writing.

The project must be commissioned at Kooka Digital’s normal quoted value. No separate entry fee is charged.

The following are excluded unless expressly agreed:

• ongoing website care or maintenance plans;
• domain registration, website hosting or email hosting charges;
• advertising spend, subscriptions, software licences, stock imagery or third-party services;
• work contracted before the Promotion Period;
• overdue, cancelled, refunded or disputed projects;
• invoices created solely to obtain a promotion entry; and
• any project that Kooka Digital has not accepted in writing.

Kooka Digital retains its ordinary commercial discretion to accept or decline a proposed project. That decision will not be based on whether a person is likely to win the promotion.

Entry limits

A maximum of one entry is permitted for each eligible client or business, regardless of the number of projects, invoices, brands, trading names or payments associated with that client.

Related businesses operating under the same ABN, ownership or control may be treated as one entrant. Entry codes cannot be sold, transferred, exchanged or assigned to another person or business.

The prize

There is one prize. The winner will receive a refund of the eligible Kooka Digital professional project fees actually paid, up to a maximum total value of AUD $10,000 including GST.

If the winner’s eligible project fees are less than $10,000, the prize will be limited to the amount of those eligible fees actually paid. The unused difference will not be paid in cash, credited against other services or transferred.

For example, if the winner has paid $4,000 in eligible project fees, the prize will be a $4,000 refund. If the winner has paid $12,000 in eligible project fees, the prize will be capped at $10,000.

Hosting, maintenance, domain charges, advertising costs, third-party expenses, interest, transaction fees and other excluded amounts do not form part of the refund.

Winner selection

One provisional winner will be selected at random from all valid entries at 12:00 pm AEDT on 13 November 2026 in New South Wales.

The draw will be performed using an electronic random selection method. Every valid entry will have an equal chance of being selected.

Before confirming the winner, Kooka Digital will verify that the selected entrant:

• holds a valid entry code;
• met the eligibility requirements;
• has paid all project amounts due at the time of verification;
• has not cancelled or materially breached the project agreement; and
• has not manipulated or attempted to manipulate the promotion.

The draw is a game of chance. Skill plays no part in determining the winner.

Winner notification

The provisional winner will be contacted using the email address and telephone number supplied with the project enquiry within two business days of the draw.

The winner must respond and provide any reasonably requested verification within seven calendar days of the first notification.

Once eligibility has been verified, Kooka Digital will confirm the winner in writing and may announce the winner’s name and business name on its website and social media channels.

Invalid or unclaimed winner

If the provisional winner is ineligible, cannot be verified, declines the prize or does not respond within seven calendar days, the entry will be disqualified and another winner may be selected.

Any required redraw will take place at 12:00 pm AEDT on 23 November 2026 using the same random selection method and location requirements as the original draw.

The replacement provisional winner will be contacted within two business days and will be subject to the same verification requirements.

Payment of the prize

The verified prize will be paid within 28 days after the winner has supplied all information reasonably required to process the refund.

The refund will ordinarily be made to the original payer and original payment method. Kooka Digital may use another traceable payment method where reasonably necessary and agreed with the winner.

Winning does not cancel the underlying project agreement. The project scope, delivery obligations, intellectual property provisions and all other project terms remain in effect.

The winner is responsible for obtaining their own accounting or taxation advice regarding the prize.

Disqualification

Kooka Digital may disqualify an entry where it reasonably determines that the entrant:

• provided false, incomplete or misleading details;
• did not satisfy these terms;
• cancelled or reversed a qualifying payment;
• created duplicate or fraudulent entries;
• interfered with the entry or drawing system;
• engaged in unlawful or dishonest conduct; or
• acted in a way intended to obtain an unfair advantage over other entrants.

Disqualification will not affect any separate rights or obligations arising under the applicable project agreement.

Changes or interruption

If circumstances outside Kooka Digital’s reasonable control prevent the promotion from operating as intended, Kooka Digital may suspend, modify or reschedule the promotion to the minimum extent reasonably necessary.

Kooka Digital will not make a change that unfairly disadvantages existing entrants. Any material change will be communicated through the promotion website and, where appropriate, directly to affected entrants.

Liability and consumer rights

Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

To the extent permitted by law, Kooka Digital is not responsible for entries or communications that are delayed, lost, misdirected or not received because of an entrant’s incorrect details, internet failure, email filtering or circumstances outside Kooka Digital’s reasonable control.

Privacy

Kooka Digital collects personal and business information to manage project enquiries, confirm entries, administer the draw, contact the winner and fulfil its legal and administrative obligations.

Information may be disclosed to service providers assisting with website hosting, email delivery, accounting, payment processing or promotion administration where reasonably necessary.

Personal information will be managed in accordance with the Kooka Digital Privacy Policy .

Entrants must notify Kooka Digital if their contact details change during the promotion.

Winner publicity

Subject to the winner’s reasonable approval and applicable privacy law, Kooka Digital may request to publish the winner’s first name, business name, general location and details of the winning project for the purpose of announcing the result.

Any use of photographs, video, testimonials or detailed case-study material will be discussed with the winner separately.

Questions and disputes

An entrant who believes an error has occurred should contact Kooka Digital promptly through the website contact form and provide their name, business name, entry code and details of the concern.

Kooka Digital will review the records associated with the entry and respond within a reasonable period. Nothing in this clause prevents an entrant from exercising any right available under applicable law.

General conditions

If any part of these terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary without affecting the remaining provisions.

A failure or delay by Kooka Digital in exercising a right under these terms does not constitute a waiver of that right.

These terms are governed by the laws of New South Wales, Australia. The parties submit to the jurisdiction of the courts and tribunals of New South Wales.
